Leasehold Enfranchisement & Reform |
 |
| |
In 1967 The Leasehold Reform Act was passed, enabling leaseholders of less valuable houses to force their Landlords to sell them their Freeholds at less than their market value. The scope of this Act was widened by the 1974 Leasehold Reform Act which gave Tenants of more valuable houses a similar right to compulsorily purchase their freeholds or extend their lease.
Similar rights were given to flat owners by the Leasehold Reform, Housing and Urban Development Act of 1993 although the exercise of these rights were made difficult by a number of procedural hurdles. These hurdles have now been substantially removed by the Commonhold and Leasehold Reform Act of 2002.
We are able to offer advice to individuals looking to purchase the freehold of their leasehold property, or indeed extend their leasehold interest. Should a decision be made to proceed with the acquisition we can represent a client in negotiating the best price; failing agreement between the parties, we can act as an expert witness before a tribunal. In the past we have acted for both landlords and tenants. |
